AKIPRESS.COM - President Sadyr Japarov today has signed a new Constitution of Kyrgyzstan adopted through referendum on April 11.
The ceremony of signing of the Constitution is held in Ala Archa State Residence.
The ceremony is attended by members of the Parliament, judges, government members, public figures.
1,322,124 people have voted in the constitutional referendum. The voter turnout has made 36.66%.
1,048,660 voted for a new Constitution or 79.3%.
181,370 voted or 13.72% against it.
The Council of Europe Venice Commission and the Organisation for Security and Cooperation in Europe's Office for Democratic Institutions and Human Rights (ODIHR/OSCE) said in a Joint Legal Opinion on the draft of new Constitution of the Kyrgyz Republic that some provisions threaten the necessary balance of power and the protection of individual freedoms, essential to democracy and rule of law.
Under the new Constitution, the President is head of state, high authority and head of the executive power of the Kyrgyz Republic. The President is a guarantor of the Constitution, human and civil rights and freedoms.
The President determines main areas of domestic and foreign policy. The President provides for unity of state power, coordination and interaction of state bodies.
The President represents Kyrgyzstan in internal and international relations. The President takes actions on protection of sovereignty and territorial integrity of the Kyrgyz Republic.
The President
1) determines structure and composition of the Cabinet;
2) upon approval of the Parliament, appoints chairman of the Cabinet of ministers, his deputies and other members of the Cabinet;
3) accepts resignation of chairman of the Cabinet of ministers, his deputies and other Cabinet members; makes decisions on their resignation;
4) dismisses Cabinet members and heads of executive agencies at own initiative or upon recommendation of the Parliament, people's kurultay [assembly];
5) appoints and dismisses heads of other executive bodies;
6) appoints and dismisses heads of local administrations;
7) forms President's Administration;
8) forms and heads Security Council;
9) appoints and dismisses State Secretary;
10) appoints and dismisses Children's Ombudsman.
2. The President:
1) makes decision to schedule referendum on his own or at the initiative of at least 300,000 voters or at the initiative of the majority in the Parliament of Kyrgyzstan;
2) schedules parliamentary elections; makes decision to schedule early parliamentary elections in the order and cases foreseen in the Constitution;
3) schedules local council elections; dismisses local councils in the order and in cases foreseen by the legislation; schedules early local council elections.
3. The President:
1) submits bills to the Parliament;
2) signs and publicizes laws; returns laws with objections to the Parliament;
3) makes annual addresses to the nation, Parliament, people's kurultay on situation in the country and main areas of domestic and foreign policy;
4) submits information on his work to the Parliament annually;
5) has right to call for extraordinary session of the Parliament and to set the issues for consideration;
6) has right to deliver speeches at sessions of the Parliament of Kyrgyzstan and people's kurultay.
4. The President:
1) submits nominations for Constitutional Court and Supreme Court judges to the Parliament on recommendation of the Justice Council;
2) submits recommendations to the Parliament on dismissal of Constitutional and Supreme Courts judges at suggestion of the Judicial Council in cases foreseen by the Constitution and constitutional law;
3) appoints local court judges at the recommendation of Justice Council;
4) dismisses local courts judges at the recommendation of Judicial Council in cases foreseen by the Constitution and the constitutional law;
5) appoints Constitutional and Supreme Courts Chairs for a term of 5 years from judges of the Constitutional and Supreme Courts judges on recommendation of the Judicial Council;
6) appoints Vice Chairs of the Constitutional and Supreme Courts judges for a term of 5 years on recommendation of the Constitutional and Supreme Courts Chairs.
5. The President:
1) appoints the General Prosecutor upon approval of the Parliament. In cases foreseen in the legislation, the President dismisses the General Prosecutor upon approval of at least half of votes in the Parliament of Kyrgyzstan; appoints and dismisses Deputy General Prosecutors on recommendation of the General Prosecutor;
2) submits nomination for the National Bank Chairman to the Parliament; appoits Vice Chairs and members of the Board of the National Bank on recommendation of the National Bank Chair in cases foreseen in the legislation and dismisses them;
3) submits nominations for half of members of the Central Election Commission to the Parliament and submits recommendations on their dismissal;
4) submits recommendation to the Parliament on election and dismissal of one third of members of the Accounts Chamber;
5) appoints Accounts Chamber Chair from members of the Accounts Chamber elected by the Parliament, dismisses Accounts Chamber Chair in cases foreseen in the legislation.
6. The President:
1) represents the Kyrgyz Republic inside the country and beyond;
2) holds talks and signs international agreements; has right to delegate powers to other officials;
3) signs ratification documents and documents on joining international treaties;
4) appoints heads of diplomatic missions abroad and permanent representatives in international organizations; recalls them; accepts credentials of Ambassadors of other countries.
7. The President decides on acquisition and renunciation of citizenship of the Kyrgyz Republic.
8. The President is Commander-in-Chief of the Armed Forces of the Kyrgyz Republic, selects, appoints and dismisses top commanders of the armed forces of the Kyrgyz Republic.
9. The President:
1) in cases foreseen by the constitutional law, warns about possible declaration of state of emergency, declares state of emergency in some areas without prior notice when necessary and immediately informs the Parliament;
2) declares universal or partial mobilization; declares state of war in case of attack or immediate threat of attack on the Kyrgyz Republic and immediately brings up this issue with the Parliament;
3) declares martial law status in the interest of protection of interests of the country and safety of citizens and immediately submits this issue for consideration of the Parliament.
10. The President:
1) bestows state awards, state prizes and confers honorary titles of the Kyrgyz Republic;
2) confers supreme military ranks, diplomatic ranks and other ranks;
3) pardons.
11. The President performs other duties foreseen by the current Constitution and the laws of the Kyrgyz Republic.
